Tinubu Broke the Law on Appointing Olukoyede as EFCC Chairman - Experts

The appointment of Mr. Ola Olukoyede as the head of the anti-corruption commission by President Bola Ahmed Tinubu has caused controversy in the opinion of some experts in Nigeria.

Yesterday, Tinubu appointed Ola as the new head of EFCC who will spend four years on the EFCC seat, before the senate confirmed his appointment.

In a statement issued by the presidential spokesperson, Ajuri Ngelale, she said, Tinubu appointed Olukoyede after the former head of the EFCC, Abdulrasheed Bawa, retired as the head of the commission.

However, some have questioned Ola's participation in the appointment, especially in view of section 2 (3) in the text of the EFCC Act of 2004 which states that the president to be appointed to the EFCC must be a person who is on duty or who has retired in the security sector of the government or has been someone who has worked in a security agency, must be someone who has work experience for up to 15 years.

But Ngelale's announcement revealed that Tinubu appointed Ola based on the power given to him by the constitution of Nigeria and in accordance with Section 2 (3) of the EFCC Act of 2004. Ngelale added that Ola, He has been working for over 22 years as a professional lawyer, where he said, he has experience in managing the operations of the EFCC considering that he once held the position of Chief of Staff during the leadership of the former EFCC Chairman Ibrahim Magu from 2016 to 2018. holding the position of the Secretary of the EFCC from 2018 to 2023 which shows that he is qualified to lead the EFCC.

However, the Director of Action Aid in Nigeria, Andrew Mamedu, was reported to have said that Tinubu broke the law that established the EFCC.

On the other hand, a professional lawyer with SAN experience number, Victor Opara, said that the appointment is correct if we consider the 2nd section of the law that established the EFCC.
